So since there's so many inconsistencies why don't you make it fair for all.
make a topic with fixed penalties for fixed crimes, so cheating = 3/6 month ban before being allowed to make an unban request
and then categorise flames under different sections like minor/moderate/extreme/ and then decide what punishments should go.
obviously then you can have another area for second offence, third offence where the ban increases

why does it depend per person ? if you want fairness then give everyone equal treatment, and then punish them more depending on their crime rate. then if someone has been punished before increase it, kinda simple to do it that way?
