The idea of a private server is that you can have your own limits on the game and add it's own type of uniqueness. However Private servers take a LONG time to set up, with things like soulsplit taking 6+ months just to finish the old free to play area. It's a risk to even make one and i agree in certain circumstances it can make money.

I'd recommend not to go with it, i'm a runescape fan but i can't say it'd work.

Ok so if we do discuss rsps,

Even though most are pking,
We should do a 317 like Koray has said which is a mixture basically, people like me like to skill and pk.

Also CLIENTS are illegal but the SERVER is not. Please read carefully and post,
making a WEBCLIENT is not illegal.

Gameplay from 317 - 718 will be the exact same in the two versions, Combat the same items the same
Its all Graphical Overhaul, Additional items & bosses
Stance overhaul & ETC.
317/314 Is shitty lookin With the same gameplay a 718 offers.

the best runescape private servers use old school, thats the whole point of a rsps, Oldschool easy making.

718 is just EXACTLY like runescape which why people dont play them and why people quit runescape.

Just did some googlin & found out that.. To get an " Legal " Rsps server
You just outta be aware of the followin

1) Don't claim anything to be yours. Make a TOS.
2) Don't use a webclient.
3) Don't replicate the Runescape website for your forums.
4) Don't host the download link for your client on your forums, host it on a file hosting website.

That pretty much covers everything client side. Server side.. apart from using the same login protocol (unless I'm mistaken), Jagex have copyrights on nothing else on the server.

& CoiN, You havent played Runescape these days if you say that lol

The source you suggested if an fiine source.

I've played on the server that had the source before they shut down & Published it, Its a fine polished server, As far as i know - Theres really not many bugs on it.
and 718 Is way better than ugly nasty lookin 317

d00m you need to chill out, that is not one of the shittiest sources it is a decent source and one of the most famous sources around. No one is trying to sound like an expert of rsps and you really cant be an expert its just some simple knowledge ...

Ive started RUNESCAPE at 2005 and started rsps at 2009.

Most of you guys in here are wrong.

Believe it or not, but the majority of servers are illegal.

You are using Jagex's Stream and Cryption classes.

There's also a belief that a TOS can save you. No, it can't. It's like murdering someone, placing them on your lawn, and then placing a sign that states 'Police officers are not allowed on this premise

So, there's really only one way around the illegality,and that is rewriting the RS client not to use anything of Jagex's. Although, if you can do this, you're better off going and making your own game.

And now, to answer your other question. Why do they care.

Well, think about this. You spend years learning how to efficiently program in Java, and you make a great game.
Now, here comes a bunch of kids, who don't bother to learn how to program properly, and they steal your game, and host it. 
Not only do you lose revenue, but you also know that these kids could also be profiting off of your hard work.

Just wait till an Emperor has something to add to this although I find it highly unlikely that this will be passed due to it's questionable legality.
